Applies to: https://legal.indiansmechamber.com/ and every page on it
1. Professional-regulatory notice
1.1Rule 36 of Chapter II, Part VI of the Bar Council of India Rules prohibits an advocate from soliciting work or advertising, directly or indirectly.
1.2This website is intended to provide factual information within the scope permitted by the professional rules and general information about Indian law. Nothing on the website should be understood as solicitation, an invitation to instruct an advocate, or a promise of a professional outcome.
1.3Any acknowledgement displayed before entry is a notice only. It does not expand what Rule 36 permits and cannot make otherwise promotional or soliciting content compliant.
1.4References to CIMSME or the Chamber of Indian Micro Small and Medium Enterprises describe an association or platform relationship. Legal services are provided only through advocates enrolled under the Advocates Act, 1961, and the contracting service provider will be Gyan Shree Law Chamber as identified in the Engagement Letter.
2. General information only; no engagement
2.1Website content is general information for a general audience. It is not legal advice and is not a substitute for advice based on the facts, documents, deadlines and law applicable to a particular matter.
2.2Law and regulatory practice may change. Although reasonable care may be taken when publishing content, we do not represent that every page will remain complete, current or suitable for your circumstances. Do not act or refrain from acting solely because of website content.
2.3Reading the website, submitting a form, sending an email or WhatsApp message, booking a consultation, or making a payment does not by itself create an advocate-client relationship. An engagement begins only after the requirements in Clause 3.2 of the Terms and Conditions have been completed.
2.4Professional privilege does not arise automatically merely because information is sent to an advocate before an engagement is accepted. Until we request it through an appropriate channel, do not send confidential documents, passwords, complete payment credentials, Aadhaar details or other highly sensitive information.
3. Outcomes, estimates and professional work
3.1We do not guarantee any result in litigation, arbitration, negotiation, registration, recovery, regulatory proceedings or any other matter. Outcomes depend on facts, evidence, applicable law, the decision-maker and the conduct of third parties.
3.2Any response period, completion estimate or procedural timeline stated on the website is indicative unless expressly confirmed as a binding commitment in an Engagement Letter. It is not a prediction of the time a court, tribunal, registry, authority or counterparty will take.
4. Third-party services and website availability
4.1The website may link to or use third-party services, including social-media platforms, communication tools and payment service providers. Their content, availability, security and independent processing are governed by their own terms and policies. A link does not by itself constitute an endorsement.
4.2A third-party payment service provider may process payments. We do not ordinarily receive or store complete card credentials, CVV, UPI PIN or similar authentication data. Report a failed or disputed payment promptly so that our records can be checked and reconciliation assistance provided.
4.3The website is provided on an “as available” basis. We may update, suspend or withdraw content or functionality. We apply reasonable security safeguards but do not claim that the website will always be uninterrupted, error-free or immune from malicious activity.
5. Intellectual property and permitted use
5.1Unless otherwise stated, website text, design, graphics, logos and other material belong to us or the relevant licensor and are protected by applicable intellectual-property law.
5.2You may view and print material for personal reference. You may not commercially republish, sell, license, systematically extract or redistribute it without written permission. Clause 9 of the Terms and Conditions applies to client-specific documents and professional deliverables.
6. Territorial and professional scope
6.1Unless expressly stated otherwise, website content concerns Indian law. We do not hold ourselves out through this website as qualified to practise the law of another jurisdiction.
6.2Advice involving foreign law will be provided only where separately agreed and, where required, through appropriately qualified foreign or local counsel. Access from outside India does not alter the governing scope of the website content.
7. Personal data and communications
7.1Our handling of personal data, cookies and similar technologies is described in the Privacy Policy and Cookie Policy. Selecting an entry acknowledgement is not consent to marketing, non-essential cookies or unrelated processing of personal data.
7.2Do not submit personal data about another person through a general enquiry unless you are authorised to do so and it is necessary for the enquiry. Matter files and third-party personal data should be sent only after an engagement is confirmed and through the channel specified for the matter.
8. Complaints and contact
8.1Website, service and billing concerns may be sent to the contact below. Privacy requests and personal-data grievances follow the procedure in the Privacy Policy. A complaint concerning the professional conduct of an advocate may be made to the appropriate State Bar Council under Section 35 of the Advocates Act, 1961.
